Receive legal advice regarding the Development Application Submittal, dated November 11, 2011, tendered by Nicholas R. Batker, Senior Project Manager of AECOM, on behalf of Exide Technologies, including but not limited to, the Vested Rights Petition, Preliminary Site Plan and Final Plat submitted therewith, and the Amended Vested Rights Petition submitted on behalf of Exide Technologies on December 2, 2011 (hereinafter referred to as ?Exide?s Vested Rights Petition?).

Receive legal advice regarding possible textual amendments to Zoning Ordinance No. 11-04-09, Section 3 (Land Uses) and Section 7 (Definitions) of Zoning Ordinance No. 11-04-09, as amended relating to the definitions of ?Miscellaneous Hazardous Use? and ?Recycling Plant?, and which zoning district(s) said uses are prohibited in and/or allowed by right, Specific Use Permit or Conditional Use.

Reconvene into Regular Session.

Consider and act on Exide?s Vested Rights Petition and the proposed City ?Order of the Frisco Planning & Zoning Commission Regarding Vested Rights Petition Submitted by Exide Technologies, Inc., on November 11, 2011, and the Amended Vested Rights Petition Submitted by Exide Technologies, Inc., on December 2, 2011?.
