CALL TO ORDER
ROLL CALL
Declare an emergency meeting of the Frisco City Council pursuant to the Texas Open Meetings Act, Texas Government Code, Section 551.045 and find that there is an emergency or an urgent public necessity and immediate action is required of the Frisco City Council regarding the reasonably unforeseeable situation related to a potential settlement with Behringer Harvard concerning its proposed modified joint consolidated plan of reorganization in Bankruptcy Court, and that December 13, 2012 is the deadline of the Frisco City Council to take action on this item.
CLOSED SESSION
Recess into Closed Session in compliance with Section 551.001 et. seq. Texas Government Code, to wit;
Section 551.071. Meeting with City Attorney regarding a matter(s) in which the duty of the City Attorney under the Texas Disciplinary rules of Professional Conduct of the State Bar of Texas conflicts with the Open Meetings Act regarding:
Receive legal advice regarding a potential settlement with Behringer Harvard concerning its proposed modified joint consolidated plan of reorganization in Bankruptcy Court
Reconvene into Regular Session and take any action necessary as a result of the Closed Session.
REGULAR AGENDA
Consider and act upon approving the proposed modified joint consolidated plan of reorganization of Behringer Harvard in Bankruptcy Court and authorizing the City Manager to vote for the proposed modified joint consolidated plan of reorganization and execute all documents necessary to effectuate the same.
